the said Defendant maketh Oath and
Saith that he is advised and believes that he hath a
very Just and Legall Defence to make to this Indictment
And that Richard Daly< no role >
of the psh of Saint Margretts
Westminster
in the County of Middlesex
Merchant
is a very Material Evidence for this Defendant in his
Defence of the said Indictment and that without his
Testimony this Deft cannot with Safety put himself
upon his Tryall And this Deft. further Saith that he
hath been Informed and believes that the said Richard

about fourteen days ageo went on Some Business to
Dunkirk in the Daminions of France and that he will
return again to London in about three Weeks therefore
for want of his Testimony this Defendant humbly hopes
his Tryall shall be put off untill next Sessions
