John Harrison< no role > the Deft. in this Cause maketh Oath and saith that he this Depot. being Indicted at the
Sessions of Oyer and Terminer held for the City of London on Wednesday the twelfth Day of Octob 1743 for
Wilfull and corrupt perjury to which sd. Indictmt. this Depot. at the Sessions held for the sd. City of London at
Justice Hall in the old Bailey on Wednesday the 35th. day of May last Pleaded Not Guilty and Entered into
Recognizance with Suretys to Try the same And this Depot. saith that Ann Cherrier< no role > Wife of Lewis Cherrier< no role >
late of London Mercht . who is a very material Witness for this Depot. in this Cause did before that time to wit
in Janry 1749 go beyond the Seas to Rochefort in France about 500d. Miles beyond Paris and is not yet
returned and the sd. Ann Cherrier did intend as this Depot believes to have come to London this Summer to the
intent she might be a Witness in this Cause for this Depot. but by a Letter which this Depot. on or abt. the
8th. day of May instant reced from the sd. Ann Cherrier she did inform this Depot. that she is big with Child &
near the time of being Delivered and not able to undertake so long a Journey but wod. come to London as soon as
she shod. be able to undergo the Journey which this Depot. believes to be true and this Depot. Saith that
without the Testimony of the sd. Ann Cherries this Depot. cannot safely proceed to Tried in the aforesd. Indictmt.
And this Depot. further saith that he being an Attorney in the Court of King's Bench in publick Busins. hath
constantly Attended the Courts at Westmr. and Guildhall and other Places where Business required for upwards of ye
years after the sd. Bill was found yet was not required to Appear and Plead to the same untill after the sd. Ann
Cherrier was so gone beyond the Seas and believes the same wod. never have been prosecuted but that Wm Sparry< no role >
(who a few months ago unjustly and multiciously Prserved an Indictmt. agt this Depot. for Barraley upon which sd.
Indictmt. he hath been since Tried and honourably Acquitted) hath for Revenge sake Stirred up this Prosecution
and wod. take advantage of this Deponent's Witness being beyond [..] and this Depot. Saith that there being other
Matters in difference between this Dept. and the sd. John Bedall< no role > at request of Ann< no role > the sd. John Beddall< no role > On the 19th. day of Janry last he this Depot. and
the sd. John Bedall Entered into Bonds of Arbitracon and left all matters in difference between them to Mr. Serjt.
Hayward who was to have made his Award on or before the last day of Easter Term now past until which day
all proceedings were agreed to be stayed But the sd. John Bedall< no role > by the persuasion of the sd. Sparry as this
Depot. believes to keep up Strife between them neglected or refused to Attend the sd. Mr. Serjt. Heyward
by reason whereof the sd. Mr. Serjt. Hayward would not perfect and finish his Award And this Depot. Apprhendg.
that all matters in Controversy between this Depot. and the sd. John Bedall< no role > wod. have been finally Determined and
which this Depot. relied upon He this Depot. for that reason is not prepared for Trial of the sd. Indictmt. and this
Dept. Saith he did on Wednesday last being the 22d. day of May instant Sonne John Bedall< no role > the Prosecutor above
named with a true copy of the Notice hereunto annexed by delivering to and leaving such copy with the Wife of
the sd. John Bedall< no role > at his house in Hedge lane near Charing Cross

If the Mocon be Opposed and the Prosecutor's Council shod. insist that in October last
an Order was made Peremplarily to Try this Indictmt. in last Janry Sessions pray acqut.
the Court that on the 19th. day of Janry last the Prosecutor and the Defendt. Entered into
Arbitration Bonds in the penalty of £500. to leave all matters whatever in Difference between them to Mr.
Serjt. shod. be respited till the then next General Sessions to be held at the Old Bailey and on the 1st. day of
March last also signed the other annexed Agreemt. whereby the sd. Trint was put off till the then next
General Sessions So that is sumoned that Peremptory order is Waived and Mr. Harrison hopes to have his
sd. Witness in Land so as to be able with safety to Try this Indictmt. in Octor. next his Witness being with Child and near the time of her
Lying in and rending in Frances abt. 500d Miles beyond paris he hopes are reasons strong enough to induce ye
Court to think he can't be ready sooner
