which was in October one Thousand Seven Hundred ye forty Eight
but the Sd. Cooke was not in England at the time of the forging or
Publishing the Receipt for which the Deft. Stands indicted nor
hath he been in England at any time since as this Dept believes And this Dept. saith
that he beleives the sd Cooke can have no knowledge of the Matters whereof the Deft. is
indicted or relating thereto And this Dept. saith that he hath
Stay'd in London to prosecute the Deft. upon the St. Indictment
above a Month last past & continues here now only for that
Purpose at a great Expence & Loss this Deft. having a Ship
built in the Sd. Kingdom of Naples to be commanded by this Dept.
which this Dept. believes only waits this Depts. Return thither &
this Dept. verily believes that the Deft. application to put off the
tryal of this cause is purely to avoid this Dept. testimony for
the King by the Absence
