Search over all his Desks Drawers Boxes Books papers and
writings and in the Pocketts of his wearing Apparell but hath not
been able to find the said Bill of Exchange And this Deponent doth
Verilly believe that the said Bill of Exchange And this Deponent doth
so that he this Deponent cannot prosecute the said George Stephen
Hearsay
< no role > for the Forgery and Felony aforesaid Pursuant to the Condition
of his said Recognizance And this Deponent further Saith that the
said Bill of Exchange if so lost or destroyed was merely by Accident
and entirely without the knowledge or privity of this Deponent and
that if he this Deponent could have found the said Bill of Exchange
he would have prosecuted the said Prisoner pursuant to the prosecutor
entered into by turn for that purpose as he intended to have done at
this present Session And that the Sole reason that this Deponent doth
not prosecute the said Prisoner as aforesaid is not being able to
find the said Bill of Exchange without which he is Advised he
cannot do And this Deponent further Saith that he hath not
Sureted parted with or disposed of the said Bill of Exchange or
permitted any person or persons to take away or secrete the same
not doth he know or hath ever heard that the same hath been taken
away or ever found by any person or persons whatsoever or hath he
this Deponent done or consented to do any thing to screen the said
George Stephen Hearsey from punishment through favor or
Affection toward the said Prisoner or any other person whatsoever
or by or through the means of any Gain Gratuity profit Reward
or the keper or promise thereof or that the said prisoner might
Escape Justice for the said offence or for any other reason or motive
Whatsoever.
