John Baptista Maresea< no role > the Prosecutor in this Cause maketh Oath and
saith That he well knows Thomas Cooke< no role > mentioned in the Affidt. of the Deft.
& hath known him for the space of Nine Years last past & upwards during
all which time the sd. Thomas Cooke< no role > hath been employed in the Service of
the King of the two Scicillys on board a Man of Warr call'd the St. Philip
of which he now is third Mate ye hath been in England but once during all
this time aforesaid (as the sd. Cooke informed this Dept. & he beleives) which
was by leave in the Year one Thousand Seven Hundred & Forty Eight when
the sd. Cooke came from Naples to London as Pilot of a Neapolitan Ship
called the St. Angels in which he arrived here in June in that Year & In
October then Next following he returned to Naples aforesd. in the same Ship
as Master thereof & hath never since been in England And this Dept. saith
that he was in company with the sd. Thomas Cooke< no role > at Naples aforessd. in the Month
of December last & then informed him that this Dept. was going to England & asked
him when he should go thither or to Ireland his Native Country or to that
Effect & he then informed this Dept. that he never intended to go any more to
England or Ireland because his Affairs were much embarrassed in both those
Countrys which he hath Often say'd was the reason of his quitting his Native
country & bringing his Wife & Family from Ireland first to Room &
then to Naples where they now live & reside & have resided for all the time aforesd.
& this Dept. saith that the sd. Cooke & the Deft. being country man were acquainted
together at Naples aforesd. as this Dept. hath heard them both say & when the [..]
Dept. first knew the Deft. which was in June one Thousand Seven Hundred
Forty Eight the said Cooke & the Deft. were also acquainted in London & so
continued to the time of the sd. Cook's last going out of this Kingdom as aforesd.
