William Clendon< no role > of the parish of Saint Mary Le strand
in the County of Middlesex Laceman maketh Oath that on
or about two years ago he completed the Dept. John Harrison< no role >
an his Attorney in order to recover a just debt of about
Twelve pounds And to this Diponent from Richard Tracey< no role >
Esqr deceased and that the sd Harrison having informed
this Deponent that he had delivered a Bail able Wait to one
Grimbell an Officer of Surry who had arrested the said
Tracey and that he saw the daed Tracey in Custody of the
said Grimboll this Deponent thereupon brought and Action
for an Escape against the Sherriff of Surry which Action
has been at Issue since last Hillary Term And this
Deponent saith that the said action would than have been
tryed but the sd Harrison who was the principal Witness
this Deponent had then informed this Deponent that he
Coud not attend on the sd Trial which was to be had at
Westminster Hall in the settings after last Term on the day this Dept Vicl into a Recognizance there being process out of this Honoble
Court upon the sd Indictment against him the said
Harrison and thereupon this Dept was induced be Enter into
there said Recognizance before the Right Honoble the Lord
Mayor too his the sd Harisons appearance at the
Ensuing Sessions And this Dept. saith that since
Entring into such Recognizance as aforesd. this Dept
has been greatly afflicted with a Violent Fever and
gent, has had a For since Cutt off, and has been given
overs by his Physicians and has not been able to shire
and without danger of his Life till yesterday when
he was carried out for the ave. And this Deponent not
