Samuel Vialls< no role > Servant to Joseph Watts< no role > of
Carnaby Market Butcher Maketh Oath That on the
13th. day of December last he this Deponent apprehended
onethe above Deft on suspicion of Stealing the said
Weather Sheep and Took him before a Justice who
Committed him to Prison to Take his Tryal And this
Deponent Saith That on the 16th. of December following
he this Deponent was Bound in a Recognizance of Forty
Pounds to prosecute the said John Waters< no role > for such Felony
And this Deponent further Saith That he accordingly
Preferred a Bill of Indictment to the Grand Jury on Wednesday
last at the Session house for the County of Middlesex
which was Returned a true Bill And this Deponent
immediately went to the Old Bailey and attended there
from that time (which was about the hour of 3 o Clock in
the afternoon) untill the Breaking up of the Court last
Night in Order to have prosecute the said Deft for such
Felony but the said Defend was not put upon his
Tryal at that time And this Deponent further
Saith That at the Breaking up of the Court last Night
he this Deponent was informed by several persons
who were also attending at the CourtalsoThat the London Jury
would be Called on the first this Morning And this
Deponent further Saith That this day being a very busg.
day with persons of his Trade and being desirous of
assisting his said Master as far as in his power this
Deponents said Master not having any Servant Capable
of Working or Employing himself at such Business but himself
He this Deponent Attended his said Masters business
untill the hour of half past 10 o Clock this Morning and
