after Cleaning himself immediately went to the Court at the
Old Bailey and was there about the house of half past
Eleven o Clock (this Deponent not in the least imagining
that he should be too late on account of the London
Jury being to be Called before the Middlesex Jury
as this Deponent was several times Informed as
above mentioned) in Order to have prosecuted the said
Defendant for such Felony when this Deponent was
informed That the said John Waters< no role > had been put
upon his Tryal and Acquitted for want of this Deponent
attending to prosecute the said John Waters< no role > Whereby
this Deponent's Recognizance became for feited and
Ordered to be Estreated as this Deponent hath been
informed and believes And this Deponent
Lastly Saith That as this Deponent's not attending
to in time to prosecute the said John Waters< no role > for the
said Felony was not through voluntary Negligence
Nor out of any Contempt to this Honourable Court
Or to Present the Defendant from [..] receiving such Punishment as his Offence Merited
This Deponent humbly hopes this Honble Court
will Order his Recognizance to be Discharged
