On the Prosecution of
Todd for an Assault

Andrew Simpson< no role > of Islington Road in the County of
Middlesex Gentleman and Henry Cole< no role > of the same place Gentleman
severally make Oath and say and first this Deponent Andrew
Simpson
< no role > for himself saith that Henry Hesketh< no role > of Birmingham
in the County of Warwick Buckle maker and William Powell< no role >
of the same Place Out Rider are material and necessary Witnesses
for this Deponent And is advised and believes that without their
Testimony he cannot with safety take his Trial upon this
Indictment and this Deponent further saith that the said
Henry Hesketh< no role > and William Powell< no role > are frequently in London
and this Deponent hath himself enquired and requested the
other Deponent Henry Cole< no role > to enquire whether they are in
Town, but is informed they are not, and are not repeated in
Town for a Fortnight And this Deponent Henry Cole< no role >
for himself saith that he is well acquainted with the said
Henry Hesketh< no role > and William Powell< no role > and hath made Enquiries
after them at the Angel Inn in Angel Street near Newgate
Street (their usual Place of residence in Town) and is informed
they are not in Town or expected in less than a fortnight And
this Deponent Andrew Simpson< no role > for himself further saith That
if his Trial is Postponed Until the next Session he has no
doubt of being enabled by that time to Obtain the benefit
of the Evidence of the said Henry Hesketh< no role > and William
Powell
< no role > and therefore humbly hopes this Court will be please
to Respite his Recognizance till that NIne.
