for this Prosecutor maketh Oath and Saith
that the Dependant William Kelly< no role >
appeared and pleased to this
Indictment and entered into Recognizances in January Session last held in
and for the County of Middlesex
, to try his Traverse this present
Session And this Deponent further Saith that he was on the
Eighth day of April instant served with the Notice of Trial hereto
annexed And this Deponent further saith he caused a
subpoena to be issued from the Clerk of the Peace of the said County
of Middlesex
on the part of the Prosecution in order to Subpoena

the person named in the Indictment, And this
Deponent further saith he did apply at the House of the said John
Copeland< no role >
Situated in Black prays Road near Christ Church
in order
to sub poena him on the part of the Prosecution where this Deponent
was in puned that the said John Copeland< no role >
had left his House and
was gone in the County some distance from London but could not inform
this Deponent what part And this Deponent further Saith that the
said John Copeland< no role >
is a Material Witness for this Prosecution and
that it would not be safe to proceed to the trial of this prosection
without the testimony of the said John Copeland< no role >
And that this
Deponent hopes and Expects to be able to procure the presence of the
said John Copeland< no role >
at the next General Quarter Session for the said
County of Middlesex
And this Deponent lastly Saith he did yesterday
serve the Defendant with a Notice hereto annexed by delivering a Copy
of the said Notice to a Female by the name of Ann Raymond< no role >
otherwise Mrs Relly< no role >
