Brief Affidt. of Deft
& anor. Sworn 14th. July 1794}


Depot. Cathcart Saith that he this Depot. being desired by the sd. Dept. R Lawless
to Stina Wm. Nash late of the Mitre Tavern or public House Mitre Court Ely place London
he this Depot, did on the 11th. Day of July inst. go to the sd. Mitre Tavern a public House
in Mitre Cot. Ely Place aforesd. which said public House the said Wm. Nash< no role > lately kept and dwelt
in and where this Depot. was informed he could meet with or get intelligence where the sd. Wm
Nash
< no role > could be met with for the purpose of Subpog. him as a Witness on the part of the other
Depot R Lawless the Deft in this Prosecution

Saith that on his enquiring for the said Wm. Nash< no role > at this said Mitre Tavern or public House
as aforesaid he was informed by the present Landlord of his said House that the said William
Nash
< no role > had lately gone to Southampton as he the said Landlord had been informed believed
but that he cod. not tell any thing else about him or word to that effect

Dept. R Lawless saith that notice of trying this Prosecution was in due time given to
the said Prosecutor Solr . Gabriel Akerman< no role > who had undertaken to receive Notice of Trial on
behalf of the said Prosecutor John Cole< no role >

Saith that he this Depot. did lately make frequent enquires after the said Wm. Nash< no role >
in Order to find out his place of abode or where he was to be met with for the purpose of
Subpg. him as a Witness on this Prosecution but without affect

Saith that the said Wm. Nash< no role > is a Material witness for him this Depot. in
this Prosecution And without whose testimony this Depot. believes he cannot safely go to
trial

Saith he will use his best endeavours to find this said William Nash< no role > for the
P pore ofof Spneg. him

Believes heshallshall be able to procure the Attendance and Testimony of the
said Wm. Nash< no role > at the Next General Session of Oyer and Terminer to be holden in and for
the said County of Middx

Depot. Cathcart speaks as to the Lewis of a Copy of the Notice annexed.
