to Late to give Evidence against the Defendant And that other
Deponent John Geart lastly saith that in Consequence of
the Bill of Indictment being returned a true Bill he this
Deponent did Attend this Court in Order to give Evidence
against the aforesaid Ann Smith< no role > but this Deponent having
waited a Considerable Time and being Ignonant of the
Custom of this Court and being Informed that the
Tryal would not come on For same Time went away in
Order to get same refreshment and when he this Deponent
returned to his great Astonishment was informed that
the Defendant had been Tryed and Requite And this
Deponent on his Oath possitively saith that on that
Account only neglected to Attend to prosecute the
Defendant and For no other purpose or Pretence
Whatsoever
