that on the Seventeenth day of January last the before
named Albion Cooper< no role > applied to him this Deponent as in
attorney for his Advice in the business andsaidthis
Deponent advised said Albion Cooper to appeal against
the said Conviction and immediately requested of the
said Magistrate a Copy of the Conviction so make
against the said Albion Cooper the act of Parliament
directing that the appellant should give or cause to be
given Notice in Writing of his of her Intent to bring
such appeal and of the matter thereof but the said
Magistrate refused to give him a Copy of the said
Conviction al though this Deponent offerd to pay him
for it and ever to write it out himself And this
Deponent further Saith that he did on [..] the
Eighteenth day of January last personally Serve the
(before named Nathaniel Bland< no role > Esquire witha
true Copy of the Notice of Appeal hereto annexed
and that at the same time the said Albion Cooper
attended together with the other Deponent Samuel
wymark in order to under into a Recognizance
pursuant to the act of Parliament to try the said
appeal and abide the order that should that made by
this Court in that behalf and pay such Costs as
should be awarded by this Court but the said Nathaniel
Bland refused to take the said Recognizance
alledging that the Appeal would not lie And this
Deponent Samuel wymark for himself Saith that
he and the said Albion Cooper did a Hand at the
time before mentioned by the Deponent Jullion in
order to enter into the Recognizance as aforesaid
but the said Nathaniel Bland refused to take
the same for the reasons before alledged And
the said Albion Cooper and Samuel wymark
for themselves further Say that on the Fifltenth
day of this present month of February they did
