make Oath & say and first this Deponent

for himself saith That the Indictment in this prosecution
was preferred & found as the last session held for the said County
when this Deponent pleaded to the same and Entired into
Recognizance to Try his Traverse thereon, at the present
Session: which this Deponent should have lone But
this Deponent saith that a treaty of Compromise
having taken place between this Deponent and the
said Thomas Mill by the Mediation of one

water an intimate fiend & acquaintance of
the said Thomas Mill & a Customer of this Deponent
who possitively assumed this Deponent that he might be
Easy from any Apprehension in respect of the said
Prosecution and that nothing further should be done
therein: which this Deponent (will knowing the intimacy
that Existed between the said Mr Drawwater & the said
Thomas Mill) was induced to believe: And for that
