called Endfield Chase in the County of Middx And William
Wilson
< no role > of the Parish of St. Martin in the Fields in the sd
County late One of the Keepers of the sd. Chase severally
Make Oath & first this Dept. Thomas White < no role > for himself
saith that on Saturday the twelfth Day of October one
thousand seven hundred & twenty three he was with Edwd.
Fitz Patrick
< no role > on the sd Chase endeavouring to apprehend &
secure John Berrisford< no role > of London Wheeler Richard Minshull< no role >
of Winch more Hill in the sd County Baker & Thomas James< no role >
of Endfield Labourer who were then on the sd. Chase armed
with Guns & Pistolls & that the sd. Thomas James< no role > did then
& there wilfully & maluiously shoot at & wound the sd. Edwd.

< no role > in so much that his Leg was cut off & that
he the sd Fitz Patrick languished of the sd. Wound some
short time & then died. And these Dept. severally say
that upon the Oaths of the sd William Wilson< no role > Thomas Smith< no role >
of Endfield & the sd. Edward FitzPatrick< no role > an Ordr was made
by his Majtie in his Privy Council on the Ninth day of
March one thousand seven hundred & twenty three to require
the sd. Thomas James< no role > & others to surrender themselves psuant
to the Statute in that Case made And these Depts Say that
the sd. Thomas James< no role > never Surrender'd himself as the same
required.
