maketh Oath and saith that he is informed and believes that James Statford< no role >
of Peckham
in the County of Surry
Carpenter
was on the Eighth day of
December last bound by Recognizance before the Right Honourable The Lord
Mayor in the Sum of Twenty pounds to prosecute John Day< no role >
at this Session for
feloniously stealing Eight Deal boards value fifteen shillings the property of
the said James Statford and this Deponent further saith that he is advised
and verily believes that the said James Statford< no role >
is a very material and the
only Witness against the said John Day< no role >
and without whose Evidence a Bill
of Indictment cannot be preferred or found against him. And this Deponent
with that he saw the said James Statford on Tuesday evening last at his
house at Peckham who was then so ill with a Rheumatick Gout as to be
unable to sit up in bed or in any manner to help himself and verily
believes that the said James Statford could not be brought to prefer a
Bill of Indictment against the said John Day< no role >
at their Session without very
great danger of losing his Life and lastly this Deponent saith that he
now applies to this Honble Court at the desire of the said James Statford< no role >
in other that the said John Day< no role >
may not escape Justice but may be
detained until the next Session at which time this Deponent hopes &
has reason to believe the said James Statford will be able and will
attend to prefer a Bill of Indictment against and prosecute the
said John Day< no role >
for the felony aforesaid
