for not surrending to a Commission of Bankruptey
issued against him on the Seventeenth of September last
maketh Oath and saith that since his being committed to
Prison William Orton< no role >
John LeMaistre< no role >
and John Ferrard< no role >
Assignees of the Estate and Effects of the Deponent at various
Times severally promised and assured this Deponent that
if he this Deponent could prevail on Josiah Kinsey< no role >
his
Uncle
to convey or assign his Property to them the said
Assignees in Paymnet and Satisfaction of the Money due
to them from this Deponent that they the said Assignees
would not at Liberty or would not prosecute this Deponent
And this Deponent Saith that in Hope of persuading
and prevailing on the said Josiah Kinsey< no role >
his Uncle to
act agreeably to the Demand or Request of the said Assignees
he this Deponent unfortunately neglected to make necessary
Preparations for his Defense on his Trial and that he is now
utterly unprepared to defend himself And this Deponent
further saith that the said Josiah Kinsey< no role >
his Uncle at
the Request of and in Affection to this Deponent actually
promised and agreed to comply with the Demander requested
of the said Assignees preposed by them as aforesaid and [..]
act agreeably thereto and that the said Assignees
severally refused and continue to refuse performing then
Promises made to this Deponent but insist on prosecuting
this Deponent notwithstanding then Promises to the
Contrary
