James Kane< no role > one of the above Defendants maketh oath and saith
That Mr. Robert Gyles< no role > of St. Ives in the County of Cornwall is a very
matterial witness for this Deponent on the Tryal of both these
Indictments and without the Benefit of whose Testimoney this
Deponent is advised and verily believes he cannot with sefely
proceed to Tryals thereof and this Deponent further saith that
he the said Robert Gyles< no role > did at the Instance of this Deponent
and at the great Expence of this Deponent come from St. Ives
aforesaid to London and did stay here during the Time of the last
Sessions this Deponent hopeing that these Indictments would have
been then Tryed And this Deponent further saith that the said
Robert Gyles< no role > did soon after leave London to go to St. Ives and directed
this Deponent to write to him when he should have Occasion for
him to attend the Tryals of said Indictments and that he would
Immediately come up and give his Testimoney thereon and this
Deponent further saith that he did accordingly on the fourteenth.
Day of this Inst. February write to the said Robert Gyles< no role > directed
to him at St. Ives aforesaid where he lives expecting that he was then
there to come to London Immediately to attend the Tryal of these
Indictments and to give his Evidence thereon on Behalf of this
Deponent But to this Deponents great surprise he this Deponent
did on monday last receive a Setter by the General Post from Bristol
from the said Robert Gyles< no role > purporting that the the said Robert Gyles< no role >
