Haldanby Moore< no role > of the Parish of St. Andrews Holborn London Gentleman
the prosecutor of this Indictment maketh oath and Saith that he was not Served
with the notice of Surrender hereunto annexed till Tuesday evening about eight
of the Clock on the tenth day of this Instant September being the evening before
the begining of this present Sessions and this deponant Saith that Mr. Thomas
Wise
< no role > Attorney at Law , Mr John Wiseman< no role > Keeper of the prison of Reading both
living in or near Reading in Berkshire and Mr Humphry Smart< no role > Inn holder as
Colechester in the County of Essex are very Material Witnesses to give evidence for
this deponant in the prosecution of this Indictment, and Without their Testimony
this deponant cannot Safely proceed to the trial of the Same: and this deponent
Saith that the Said notice hereunto annexed Mentioning the Surrender and trial of the
defendant Robins intending to be on the next day after this deponant was so Served
therewith, this deponant therefore apprehended is quite improbable (if not impossible)
to Subpanea his Said Witnesses and procure them to be in [..] to attend the Said trial
by reason of Such Short notice as aforesaid, and the Said defendant Robins having never
been taken or entered into any Recognizance to plead, Surrender, or try his Traverse
on this Indictment, notwithstanding, this deponents endevours to have the Said Robins
taken So to doe by Virtue of two Several Warrants granted by the Honourable Mr.
Justice Foster upon Certificates of the Said Indictment being found against him
Which was so found Several Sessions agoe, and this deponent Saith that Julius Hill< no role >
one other of the defendts. in the Said Indictment hath not yet appear'd pleaded, or Surrendred
to the Said Indictment, or Given any Notice Whatsoever to this deponent of his intention so
to doe, therefore this Deponent is advised and humbly Submits it to the Judgment of this
Honourable Court whether the Said Defendts. Minerd and Robins can Regularly Try their
Traverse of the Said Indictment, without the said other defent. Julius Hill< no role > Joining
therein; and lastly this depont. Saith that he will Subpena his Said Witnesses Thomas Wise< no role >
John Wiseman< no role > and Humphry Smart< no role > in due time and Wittnese his Utmost endeavours & industry to
procure their attendance on the Tryal for the prosecution of this Indictmentagainstat the
Next Session at which time he doubts not but to procure them to attend thereon; he this depont.
being now ready and Willing to enter into Such Recognizance as this Honourable Court
Shall think proper to pro [..] the Said Tryal with Effect at the next ensuing Session
against all the defts. or any of them is Such Manner as this Honourable Court shall
think proper to Direct
