on the Prosecution

Barbara< no role > the Wife of John Harrison< no role > the Deft. in this Cause maketh Oath that this Depts. husband being
Indicted at the Sessions of Oyer and Terminer held for the City of London on Wednesday the twelfth
day of October One thousand Seven hundred and forty three for wilful and Corrupt Perjury to which
said Indictment the Defendt. at the Sessions held for the said City of London at Justice Hall in the Old
Bailey on or about Wednesday the thirteenth day of May One thousand seven hundred and fifty
Pleaded not Guilty and Entred into Recognizance with Sureties to Try the Same And ths Depont Saith
that Ann Cherrier< no role > Wife of Lewis Cherrier< no role > late of London Merchant who is a very material Witness
for the Defendt. in this Cause did before that time to wit in January One thousand Seven hundred &
forty nine go beyond the Seas to Rothfort in France about five hundred Miles beyond Paris &
is not yet returned and the said Ann Cherrier being then Pregnant and near the time of her
Delivery as she informed this Depont. by a Letter dated on or about the month of Septr. Last
by means whereof she was not able to come to England And this Depont. further Saith that by
another Letter from the said Ann Cherrier this Depont. is informed and beleives that the said
Ann Cherrier by reason of a further indisposition hath not been able to undertake a Journey to London
without the utmost danger of Loosing her life and verily beleives the said Ann Cherrier
will come to England on or about the Month of May next and not Sooner And this Depont.
Saith that without the Testimony of the said Ann Cherrier the Defendt. cannot Safely proceed
to Tryal, in the aforesaid Indictment And this Depont. further Saith that the Defendt.
being an Attorney in the Court of Kings Bench in very publick Business and hath
very constantly attended the Court at Westminster and other Places where business
required him for upwards of Seven years after the said Indictment was found Yet he
was not required to appear and plead to the said Indictment untill after the said Ann
Cherrier was gone beyond Seas And this Depont. further saith that she this Depont. hath
Reced a Letter from Lewis Cherrier< no role > the husband of the said Ann Cherrier dated from
Rothford the Eighteenth of this present Month New Still That she is now sick inSuchbed
which this Depont. beleives to be true.
