and upon debate of the matter in question touching
the same Is of opinion that the same are deficient
and do not contain a perfect Accompt of such matters
and things as was required by the said Order, and
that the said Trustees have therein and in Severall
other matters disobeyed the said Order and are
therefore guilty of a Contempt thereof and ought
to be prosecuted for the same, Whereupon It is
Ordered by this Court that the Clerk of the Peace of
this County Do cause an Indictment to be preferred
and prosecuted in his Majesty's Court of Kings Bench
at Westminster against the said Trustees or such
of them as were Served with the said Order for the
said Contempt, And this Court doth further Order
that it be And It is hereby recomended & referred
unto Robert Thornhill< no role > Esqr . Sr . Samuel Leonard< no role >
Baronet William Farrer< no role > Martin Ryder Matthew
Holworthy Narcissus Luttrell< no role > William Cowper< no role >
John Metcalf< no role > JosephJohnHayne William Prestley< no role > John
Clarke Daniel Dolins William Dawsonne
Thomas Burdus< no role > Alexander Ward< no role > and Daniel
Combes Esquires Justices of the Peace for this
County or any three or more of them to consider
of what proper methods may be used to enforce
the said Trustees and their under Officers Agents
and Servants to make a true and full Discovery
of the Dutys and Toll reced in pursuance of the said
Act of Parliament, and how disposed of, and also
to be Subject and Obedient to the Orders and
regulation of his Majestys Justices of the Peace
for this County assembled in Quarter Sessions according
to the intent of the said Act, And to report their
Opinions touching the Premisses unto this Court.
