severally make oath [..] and Say and first
this Deponent
David Philip Jenkinson for himself Saith
That he this Deponent
was present at and took down
the Examinations of several Witnesses before Mr Alderman
Watson on the nineteenth day of June last when upon
the Depositions of such Witnesses the above named William
Fillery was committed to Prison by the said Alderman for
having feloniously shot at and wounded the said William
Hayes and this Deponent further Saith That on account
of the said William Hayes< no role >
having as was the opinion of
the house Surgeon
of the abovementioned Hospital who
from the time of the said William Hayes< no role >
being brought
there til and during the last sessions the said William
Hayes was so ill from the said shot wound that he
was in imminent danger of losing his life thereby
and was not then able to be removed from the said
Hospital whereupon Application was made to the
Honourable Court at the last General Quarter session
and Goal delivery for the City of London
that the
said William Fillery< no role >
might be and he was
thereupon admitted to Bail to appear at this
present Sessions to answer to all and singular Indictment
which might be preferred against him the said
William Fillery< no role >
And this Deponent
further saith that
he did on the Eleventh day of September instant serve Mr.
Mayors who acts as Sollicitor for the Defendant
in this
Prosecution with a Copy of the Notice hereunto Annexed by
leaving the same with a Clerk of the said Mr. Mayors at his
House in Ely

remains an In patient in the said Hospital confined to
his Bed and unable to be removed out of the said
Hospital from the consequences of a that wound in his
