On the prosecution of Edmund Halliday< no role > Esqr
for Felony.

John Scott< no role > of Cumber Court in the Borought of Southwark Gentleman
and David Prothero< no role > of Langley Street Middlesex Gentleman
severally make Oath and say and first this Deponent John Scott< no role > for
himself saith that he was on the eighteenth day of december last bound by two
Recognizances in the Sum of Fifty pounds each for the personal appearance of
one James Scott< no role > at the then next Session to be held for the City of London to
answer the Complaint of Edmund-Halliday< no role > Esquire on suspicion of having
feloniously stolen several Articles of Wearing Apparel his property And also
another Complaint for receiving Goods stolen by a person unknown and this
Deponent saith that in Order to prevent any mistake happening he applied to
No Mr. Mullen of Ratcliff Highway Attorney for his advise and directions how to
proceed in the business who told him to attend with the Prisoner at the Sessions
in the Old Bailey in January last but did not give them any directions or
Instructions what they were to do there and accordingly this Deponent attended
with the said James Scott< no role > at the Rose Coffee House in the Old Bailey several
days during January Session aforesaid and until they were informed by these
Attorney that they might go home for that nothing could be done at that
Session And this Deponent saith that he intirely depended on his Attorney for
the business to be done properly and would have surrendered the said James Scott< no role >
to take his Trial at that Session if this Deponent hire [..] known or been informed in
what manner it was to be done And this Deponent saith that he did not hear
the Prisoner called to appear at that Session nor did he hear from any person that
his Name had been calld at that Session And this Deponent further saith that
he did before the following Session employ another Attorney for the purpose of
giving a proper Notice to the prosecutor of this Deponents Intention to surrender
the said James Scott< no role > at the then next Session to take his Trial And this Deponent
attended with the said James Scott< no role > and his Witnesses at the said Session to wit
February Session last for that purpose when to the great surprize of this Deponent
the Attorney had not served the proper Notice personally but had sent it in a
