Letter to the Prosecutor and therefore the said James Scott< no role > could not Surrender
and be Tried at that Session And this Deponent further Saith that
imediately after such Session he employed Mr. Crosley of the Adelph's
Attorney to direct them in the business and this Deponent had the said James
Scott at the Session House to surrender at the then next Session to wit April
Session last when the Attorney attended to prove a Notice given to the
Prosecutor in Order torntitle the said James Scott< no role > to be tried when it
appeared that the person who had been served with the Notice was
another Mr. Halliday and not the Prosecutor upon which the said James
Scott could not be tried at that Session And this Deponent saith that he
hath several times since applied to David Prothero< no role > the person who
apprehended the said James Scott< no role > originally for this Offence who advised
him to do nothing until Mr. Halliday came to Town And that during the
Sessions in January February and April last this Deponent [..] ted
intirely to the Attorneys he employed who neglected the business as is
before stated and that since that time he has not surrendered the said James
Scott, The Prosecutor not having been in Town but being as this Deponent has
been Informed in Camp near Plymouth and being advised by the said
David Prothero< no role > to wait his Arrival in Town. And this Deponent saith
that the said James Scott< no role > has lately been apprehended on another
Charge of Felony and is now a Prisoner in Tothilfields Bridewell as
this Deponent has been informed and believes And lastly this Deponent
saith that he was always ready and desirous to have complyed with the
Condition of the said Recognizance and to have surrendered the said
James Scott< no role > to answer for the said Offence but that he has been presented
from so doing by the means and from the reasons abovementioned and
not from any wilful neglect or from any desire that the said James
Scott should escape Justice or from any other motive or reason
whatsoever. And the said David Prothero< no role > for himself saith that
he Remembers seeing the said James Scott< no role > at the Rose Coffee house on the
