for a Misdemeanor

Edward West< no role > of Darkhouse Lane< no role > Victualler maketh Oath
and Saith that he was bound by Recognizance before the Right
Honourable the Lord Mayor< no role > of the personal appearance of his
Son Edward West< no role > at thelastSession held for the City of London
in the Month of September last to give Evidence against
one Samuel Bicks< no role > on the Charge of one John Hatton< no role > for
having assaulted him with intent to Commit Sodomy, And this
Deponent further saith that his Son did appear at the said
Session in Order to give Evidence upon any Indictment that
might have been preferred by the said John against the
said Samuel but that the said John Did not prefer any
Indictment whatever against the said Samuel by which
means this Deponent could not comply with the Condition
of the said Recognizance and it became forfeited. And this
Deponent saith that the only Evidence his Son gave before the
Magistrate was that he had Stoped the said Samuel Bicks< no role >
upon the Care assertion of the said John and at his request
and this Deponent further saith that he is informed and
verily believes that his Son could not have given any other
Evidence whatever than what he gave before the Magistrate
which could not at all effect the Prisoner or be necessary to
procure a bill of Indictment to be preferred or found for the
said Offence
