Upon his Oath Saith That about Seven OClock in the
Monday Evening he saw the deceased and another
Man come up the passage from the public House into
the Court stripped and saw ye deceased as became
into the Court drop on his knee seemingly in liquor
or much beat but whether he dropped himself or was
pushed cannot tellthey went to fighting & the Man
who fought with him presently knocked him down
and deceased fell backwards with his head to the
ground and as he was endeavouring to get up the
Man who fought with him [..] struck him again
before he could rise and he fell again.Saw Mr.
Rutherforth interfere who endeavoured to get the
deceased away but the Man who fought with
the deceased and the others who assisted got him
away from Mr. Rutherforth the deceased then endeavoured to get away
himself towards the pump strinking to avoid
the blows of the Man who fought with him and
that Man then came behind the deceased and struck
him a most violent blow under his less [..] Ear and
knocked him to the Ground with great force
in so much that Deponent heard his head rebound
against the Stones Saith the deceased he was covered with blood soon
Afterwards he was taken away by some Men
