against
John Ware< no role > for Felony

John Wheatley< no role > of Dover Street Piccadilly in the County of
Middlesex Labourer Maketh Oath and Saith that he this Deponent
on or about the Twenty Seventh day of September One Thousand Seven
Hundred and Seventy Four was bound by Recognizance in the Penal
Sum of Forty Pounds before William Addington< no role > Esquire one of his Majesty's
Justices of the Peace for the said County of Middlesex Upon Condition
that he this Deponent should prosecute the Law with effect and give
Evidence in his Majesty's behalf against the said John Ware< no role > for Feloniously
Stealing Four Shillings and Six pence in Money the property of this
Deponent And this Deponent Saith that he Understood he was to go to
the New Guildhall Westminster and there prosecute the said John Ware< no role >
And that he this Deponent did attend at the said New Guildhall Westminster
the first day of the next Session after he entered into the above Recognizance
as aforesaid and continued to Attend there from Day to Day until the said
Session was over And this Deponent Saith he did not know that he was
to prefer a Bill of Indictment against the said John Ware< no role > for the said
Offence but that he this Deponent being entirely ignorant of matters of this
kind understood and imagined that the said prisoner would be brought up
and that he this Deponent should have been called upon to give his
Evidence against him And for which purpose this Deponent regularly
Attended at the said Sessions as aforesaid And this Deponent Saith that he
has since been informed that his said Recognizance is forfieted the said
John Ware< no role > having been Discharged by this Honourable Court for want of
this Deponents prosecuting him according to the Condition of his said
Recognizance And Lastly this Deponent Saith that he did not Neglect to
Attend and prosecute and give Evidence against the said John Ware< no role > through
any favour or Affection for him or for any Reward or the hope or promise
thereof but that it was entirely occasioned by the means aforesaid and
through no other reason or motive whatsoever therefore this Deponent
humbly prays that this Honourable Court will be pleased to Order his said
Recognizance to be Discharged.
