Neglected to prosecute the said Thomas Burdett< no role > and Charles
Mc Locklan
< no role > for the said Felony According to the Condition thereof
And this Deponent further Saith that the said Thomas Burdett< no role >
and Charles Mc. Locklan were not Apprehended for the Felony
above Mentioned but that Previous to this Deponents being so
bound in Recognizance as aforesaid they the said Thomas Burdett< no role >
and Charles Mc. Locklan had been taken on a change for another Offence
and this Deponent further Positively saith that he did not know
that they the said Thomas Burdett< no role > and Charles Mc. Locklan or either
of them were committed for the Felony above Mentioned or that he
this Deponent was bound by Recognizance as aforesaid to Prosecute
them but that if he this Deponent had known that he should have
prosecuted the said Thomas Burdett< no role > and, Charles Mc. Locklan
he would have very readily so done at the same Time he so prosecuted
the said Solomon Bellendine< no role > as aforesaid And this Deponent
also saith that he being unacquainted with and not knowing how
to proceed in the above Prosecution the Clerk to the said Magistrate
gave the Instructions to the Clerk of the Indictments at Hicks Hall
aforesaid to draw the Bill of Indictment so Preferred by this
Deponent which was as above Mentioned only Against the
said Solomon Bellendine< no role > And Lastly this Deponent
saith that he did not Neglect to Prosecute the said Thomas
Burdett
< no role > and Charles Mc. Locklan through any favour or
Affection for them or either of them or for any Reward or the hope or
Promise there of but that it was entirely occasioned by the means
aforesaid and through no other Wason or Motive whatsoever
therefore this Deponent humbly Prays that this honourable
Court will be pleased to Order his said Recognizance to be
Discharged.
