Jury's return into Court he this Deponent did Again Apply to
the Clerk of the Arraigns for the purpose aforesaid who informed
this Deponent that as this Deponent had [..] Mist the
Oppertunity to have the said Prisoners Tryed in their Turn
he did not apprehend the Tryal of the said prisoners would
come on that Night but that this Deponent must Attend or
words to that Effect and this Deponent did Accordingly Attend
this Honorable Court Until about Seven of the Clock in the Evening
of that day when he this Deponent again intreated the said
Clerk of the Arraigns to bring on the said Tyal and at the same
time informed him that if the said Prisoners Tryal did not come
on that Evening he this Deponent could not be Able to Attend
on the next day being obliged to go a Journey to Ferry Bridge in
Yorkshire on Business which this Deponent could not avoid
without the greatest in convenience And this Deponent Saith
that the Tryal of the said Prisoners not coming on that Evening
he this Deponent did the next Morning being Saturday Setout
on his said Journey and did not return Until the Tuesday
following when this Deponent was informed the said Session was
over and that the said Prisoners word Acquitted for want of Evidence
And this Deponent Saith That he did not Neglect to Attend to
Prosecute the said Prisoners through any favor or Affection
toward the said prisoners or to Screen the said prisoners from
Justice or by or through any gain or Reward or the hope or
promise thereof but that he this Deponent would have Staid
in Town and appeared prosecuted and given his Evidence against the
said Prisoners (as he was allways ready and willing to do) if this
Deponent had not been under the Absolute Necessity of going his said
Journey to Ferry Bridge aforesaid and that such his Neglect was not
by or through any other View Motive or inducement whatsoever.
