of April in the Year aforesaid was sitting upon a certain Dray laden with an empty Butt and Firkin and driving three Horses
drawing the said Dray, the Property of Burnaby Green Brower, along the Kings Highway from Chelsea
in the County of
Middlesex
towards the Brewhouse of the said Burnaby Green, situate in the said Parish of St. Margaret within the liberty
of Westminster
in the said County, And that the said

near Chelsea WaterWorks did Whip the Shaft Horse harnessed to the
said Dray, by means whereof the said Shaft Horse immediately sprung forward, and the Tug Pins which were to secure and confine the said
Shaft Horse within the Shafts of the said Dray, being then unfortunately dropt out of their Places: It so happened that upon such Springing
forward of the said Shaft Horse, the Shafts of the said Dray did then and there violently fall to the Ground, and the said

thereby then and there forced to the Ground, and the near Wheel of the said Dray did then and there casually accidentally and by
Misfortune instantly pass over the Body and Loins of the said

in his Body, of which he languished from the said tenth day of April in the year aforesaid, until the thirteenth day of the same Month in the
