at the last June Session for the above Robbery
which having failed to do he this Deponent
was on the thirteenth day of October last served
with a Notice from the Office of the Clerk of the
Peace for the said County of Middlesex informing
this Deponent that in consequence of his having
neglected to appear at the said Sessions to
Prosecute the said Mary Parker< no role > and Martha
Sims
< no role > the said Recognizance was become for feited
and would be estreated into the Court of Exchequez
from whence execution would Proceed for the buying
Forty Pounds on this Deponents Goods and Chattles
unless care was taken to stop Proceedings by an
Application for a respite at the then next Session
And this Deponent further saith that in consequence
of the above Notice he did attend at the Sessions
House and was informed there by the Clerk of the
Peace that it would be necessary for this Deponent
to make an affidavit of the above mentioned facts
And also the reasons why this Deponent neglected
to appear and Prosecute the said Mary Parker< no role >
and Martha Sims agreeable to the Conditions of
the said Recognizance so entered into by this
Deponent as aforesaid And this Deponent further
saith that it was not through any wilful or
intentional neglect on the part of this Deponent
that he omitted to appear and Prosecute the
said Mary Parker< no role > and Martha Sims at the
said Sessions but Solely on Account of this
Deponents being intirely ignorant of the nature
