aforesaid Taylor
the
Defendant above named maketh Oath and Saith That in May Sessions
last past a Bill of Indictment was found against him the said Deponent by
the above named Mary Cooke< no role >
for an Assault And this Deponent further
Saith that in June Session last past He the said Deponent appeared in
Court to the said Bill of Indictment and entered into Recognizance to Traverse
the same at this Present September Sessions And this Deponent further
Saith That He this Deponent being ignorant that by an Order of this
Court bearing date the fifteenth day of May 1766 It was Ordered, " That
"for the time to come all notices of Tryal of Traverses be given on or before
"the Wednesday proceeding the Sessions. "hath Omitted to give Notice of Tryal
in time accordingly to the Prosecutor above named And this Deponent
further Saith That he did not omitt giving such Notice in time with any
View or Intent of delaying the Tryal of such Traverse as aforesaid
