the letter of Attorney by Virtue of which the said Oliver Mc. Allester< no role > reced
the sd. pay from the sd. Mrs. Gearing & that the sd. Oliver Mc. Allester was concerned
with him in such Forgery and the next day being the third of the same Sepr . we
confessed that the sd. Oliver Mc. Allester was concerned with him in forgeing servr.
other marines wills whose names he mentioned most of which wills were found
in the Commons and this Dept. George Campbell< no role > for himself further saith that the
said George Sweatman< no role > being Examd. on the 4th. & 5th days of Septr . by the sd. Mr.
Lidiard & his Examination being taken in Writing & sworn to by the sd. George
Sweatman
< no role > in Substance as a foresaid The sd. Justice did on the fifth day of the
same Sepr. Grant a Warrts. under his hand & seal directed to the Keeper of
newgate or his Deputy to detain the Body of the sd. Oliver Mc. Allester being
further charged with Feloniously Forgeing the will of our James Ratheray< no role >
otherwise Rothery< no role > and publishing the same knowing it to be forged & liner
safely to keep in his custody until he should be Discharged by did course of
Law which sd. warrt. was the same day Delivered to the Keeper of
newgate or his Deputy in whose Custody the said Oliver Mc. Allester< no role >
was then for a Felony and the said George Sweatman< no role > being admitted an
Evidence on behalf of the Crown was Committed a prisoner to new Prison
Clerken will in the county of middex And this Dept. George Campbell< no role > for himself
further saith that the sessions begining at the Old Bailey the next day being the
sixth of the same Septr . and there not being sufficient time to have an Indictmts.
prepared and found agt. the said Oliver Mc. Allester< no role > the said Oliver Mc. Allester< no role >
moved the court at the old Bailey by his Councel that the might be Bailed which
the court absolutely refused and thereupon the sd. Oliver Mr. Allester was remanded
back to Newgate and this Depts. George Campbell< no role > further saith that before
the then next ensuing Octr. sessions the said Oliver Mc. Allester found means to
get himself Bailed out of newgate before the then Lord mayor of the City of
London and his Bail were John Mc. Donnell< no role > & his Bros.Dennis Mc. Donnell< no role >
then both of chelsea and this Dept. George Campbell< no role > further saith that two
Days after the said Oliver Mc. Allester< no role > was so Bailed as aforesd. to this
Dept. had a Bill of Indictmts. Prepared and found agts. him and this Depts. was
ready and desirous at that time and always since till the Discharge of
the sd. Sweatman ashew in after mentioned to have preceeded to try the
said Indictment and this Deptr. George Campbell< no role > further says that the
said Oliver Mc. Allester< no role > was so Bailed as a foresaid without any notice
being given to this Dept. or further Depts. then sollr. Mr. Matthew Roe< no role >
as this Depts. verily between for this Depts. possitively says that if he had had
