maketh Oath and saith that he was bound by Recognizance to
prosecute
Joseph Newton< no role >
for stealing from him this Deponent
a
Bundle of brooms of the value of three shillings, at the last Session
held for the said City in the Month of September last, And this
Deponent
further saith that his partner
Joseph Horton< no role >
being at
that time exceedingly ill by which the business develved wholly
upon this Deponent
, his mind was thereby so much occupied in his
business as that the Recognizance he had entered into as aforesaid
slipped the Memory of him this Deponent
, And this Deponent
further saith that imediately on the business occuring to his Mind he
went to the Session house
in the Old Bailey
with an intention to prosecute
the said Joseph Newton< no role >
for the said Offence when this Deponent
was
informed that it was too late as the Grand Jury were Discharged
And this Deponent
further saith that he did not neglect to
prosecute the said prisoner
from any favor or Affection or for any
Reward hope or promise thereof but that it was his full intention
to have prosecuted the said Joseph Newton< no role >
, had he not been
prevented by the means above mentioned
