Maketh Oath and Saith that he did
on the Twenty fourth day of this Instant May Cause David Thomas to be personally Served with a
Subpcena to give Evidence for the Prosecutor in the above Cause at Eight of
the Clock this Morning, the said David Thomas having
Attended for that Purpose several hours Yesterday and at the
time this Deponent so caused him the said David Thomas to
be Served with such Subpcena he informed this Deponent
that he the said David Thomas was Obliged to Attend a
Tryal this Morning at Westminster Hall, and would
Return back this Morning to give Evidence on the said
Indictment but is not yet returned And this Deponent
further Saith that he the said David Thomas is a
Material Witness for the Prosecutor in this Cause and
without whose Testimony the Prosecutor cannot Safely
Proceed to the Tryal of the said Indictment.
