such Horse besides Costs of Suit which this Deponent
hath accordingly Paid to Mr. Woolrich Attorney for the
said Mark Ebblewhite< no role > in such Action And this Deponent
further Saith that since which this Deponent on
receiving Information that the said Person who brought
the said Order and had the said Horse so delivered to him
as aforesaid was in Town he this Deponent caused him
to be brought before Mr. Justice Westr in Tickfield Street
in the County of Middlesex before whom the said John
Dean swore to the best of his Knowledge that the Person
so brought before the said Justice was the same Person
who brought such Order as aforesaid Whereupon the sd
Justice apprehending it more Proper he caused him to
be taken before the then Sitting Aldermen at Guildhall
London who committed him for further Examination
And this Deponent Saith that other Examinations
were had at one of which two Persons appeared before
the sitting Alderman at Guild hall aforesaid and [..]
to such Person being in the Country on the said
twenty second of July One thousand seven hundred and
seventy four on which he was admitted to Bail and
this Deponent and the said John Dean< no role > bound over to
Prosecute And this Deponent further Saith that on
such Proof of his Absence he is unwilling to prosecute
such Person not being clear of his Indentity therefore
most humbly Prays that the Recognizance so entred
into by this Deponent and the said John Dean as
aforesaid may be discharged
