The King agt Thos. Smith< no role >

Thomas Butts< no role > & John Clappinson< no role > are bound
over by Recognizance to prosecute the Smith
for Stealing £38. of Tobacco off the Keys, the
Property of persons unknown

The reason of their being bound over to Prosecute
was, that they are both Officers of the Customs &
having Missd the Tobacco, there was reason
to believe Smith had Stole it

The Comr. of the Customs having had this Matter
laid before them for their directions, do not think
there is a Sufficient foundation to prosecute the sd.
Smith for felony, and therefore have given directions
to their Sollicitor to move the Court for the discharge
of the sd. Butts & Clapinsons Recognizance

The Prisoner is not in Custody

Be Pleased therefore to move that the
Sd. Butts & Clapinsons Recognizances
may be discharged
