Mr. Ortons (pursuantto previous appoint-
ment with him andMr. Bennett to meet)
and waited his gettingready and brought
him with him by a little after Ten finding Mr. Bennett
had called and was come on before that And saith that
he was very sorry and greatly surprized when he found
the Prisoner had been just acquitted and Discharged
out of Custody for want of this Deponent's appearing
against him And the said Edward Bennett< no role > for himself
saith that being bound over to give Evidence concerning
the Abovementioned Felony he attended the Grand Inquest
on Monday last at the finding of the Bill and Yesterday
morning set out from his House at the further End of
the Minories betwixt Eight and nine of the Clock and
called on Mr. Orton the other Deponent to meet him
and the said Prosecutor according to appointment
made between them on Monday after the Bill was
found that they might come together and attend this
honourable Court to testify upon the trial And that
Mr. Barriff not being met this Deponent came
forward and wrought this place about half an hour
after nine and presently after heard his Name called
over on which he went up towards the Person that
called him who ask'd him if he was Prosecutor and
on this Deponents telling him he was not ye Prose-
cutor the said person gave him to understand he was
not the person wanted or that he might stay there
till the said Mr. Barriff came thinking that he cou'd
not be Serviceable till then And the Deponent Thos.
