for Single Felony.

Peter Robinson< no role > of Nicholas Lane London Oilman maketh
Oath and Saith that he this Deponent was bound over to Prosecute
the Defendant in this Cause for the felony aforesaid at this Present
Session and that John Tudman< no role > this Deponents Servant was bound
over to give Evidence thereon And this Deponent Saith that on a
Wednesday Morning last the very first Cause on the London side the
said Defendant in the absence of this Deponent and his said Servant
was caled to the Barr and Acquitted for want of Prosecution And
further this Deponent Saith that he and his said Servant were that
Morning extreamly Engaged in Business and did not apprehend that this
Honourable Court would so early have gone upon the Business of the
said Session which was the only cause together with the business aforesd
this Depond & his Servant did not Attend so soon as they should have
done but that they were both Attending this Court about the Hour of ten
a Few Minutes after the said Defendt. was discharged And lastly this
Deponent saith that about three weeks before the said Session began
his said Servant was to have gone about a Month's Journey into the
Countrys of this Kingdom on Account of business and that this Depont. kept
his said servant at home all that time from going his said Journey
in Order that his said Servant might Attend this Honble Court with him
this Deponent to give Evidence as aforesaid.

Sworn at Justicehall in the
Old Bailey London the 17th. Day of
September 1751 .
