The King on the prosecution of William Gregson< no role > and Joseph
Day

against
Ferdinand Burlton< no role > for Perjury

Joseph Day< no role > of Kirby Street Halton Street in the County of Middlesex Gentleman
maketh Oath and saith that Isaac Gillatt< no role > is a material Witness in support
of this prosecution and this Deponent did on the Sixteenth day of this instant
April procure a Subpanan for the said Isaac Gillatt< no role > to give evidence on
the Trail of this Indictment but he having removed from his late dwelling
house in Rolls Buildings Fetter Lane and being as this deponent believes in
very indigent circumstances this Deponent hath not been able to see or procure
any intelligence where the said Isaac Gillatt< no role > was to be found until this day
altho' this Deponent hath caused strict search and inquiry to be made after
him And this Deponent having this day discovered the said Isaac Gillatts
lodging hath been informed that he is out of town but is expected to return
in a few days And this Deponent further saith that having subpaned James
Fenton
< no role > of Chelmsford in the County of Essex Sheriffs officer as a Witness in support
this prosecution the said James Fenton< no role > did attend at the Old Bailey this Morning
but this Deponent not having been able to Subpana the said Isaac Gillatt< no role >
and the said James Fenton< no role > having informed this deponent that he had very
urgent business at Chelmford and this Deponent believing that this Honorable
Court upon an Affidavit of the said Isaac Gillatts materiallity and absence
would if course postpone the Trial of this Indictment until the day of
which this Sessions may be adjourned this Deponent did for these reasons
consent to the said James Fenton< no role > 's return to Chelmsford and this deponent
doth verily believe that he hath accordingly left London and is on his way
home to Chelmsford aforesaid and this Deponent Saith he verily believes he
shall be able to Subpana the said Isaac Gillatt< no role > and procure his
attendance as a Witness on the Trial of this Indictment at the
next sessions
