to Trial at this present Sessions for want of the benefit of
such Testimony and that he hopes and verily believes that
he shall be able to procure them at the next ensuing Sessions
of the peace for the said County of Middlesex and City [..]
of London-And this deponent also further saith that
from the distance of the place where the said Offence was
Committed which is near twenty three Miles from London,
and also from the distance of the place of his residence
which is about Seventy Four Miles from London, and from
he shortness of time from his Commitment to the present Sessions
and the impossibility of his being able to procure either
those Witnesses to Fact or Proper persons to his character who
are persons of great Respect and good Character [..] Deponent
cannot take his Trial with the least possibility of and is
precluded from, making that defence which the nature of
his case demands and the danger of it requires especially
as the Charge affects this Deponents Life. And Lastly this
deponent saith that this his Deposition and Application to
this Honorable Court are not made with any view to delay or hinder the due
Course of Justice or to postpone his Trial without just grounds
and also that he shall be ready to take his Trial at the
next Ensuing Sessions for the said County of Middlesex and
City of London .
