the above named Defendant maketh Oath Saith that at
the Sessions held in September now last Past the said Cockburn
Webster preferred and caused to be found a Bill of Indictment
against this Deponent for an Assault upon him the said
Cockburn Webster to which Indictment this Deponent at the same
Sessions Pleaded Not Guilty and thereupon entered into Recognizance
with sufficient sureties to appear at this present Sessions to take
his Treat upon the said Indictment And this Deponent fully
intending to take his Trial accordingly did on the Seventh day
Day of October instant cause due Notice to be given to the said
Cockburn Webster that he this Deponent would at this present
Session to be holden for this County at the Session House at
Clerkenwell Green
on Monday the twenty six day of October instant
and then and there take his (this Deponent's) Trial upon the said
Indictment and Plea of Not Guilty so Pleaded thereto And this
Deponent further saith that he did Yesterday attend this Court
accordingly and thatthathe then found he could not take his
Trial for that this Deponent had not caused a Writ of Venire to
issue [..] and the said Indictment to be set down for Trial the necessity
whereof this Deponent saith he was wholly ignorant or he would
have caused the same to be done but moreover this Deponent saith
he is in other respects ready and willing to take his Trial in the said
Indictment at this present Sessions if the Prosecutor will consent
thereto and this Court shall so please
