contains in length two hundred and twenty feet in
the same manner as that already done and to leave
that pavement in the same manner as in the former
contract is expressed In consideracon whereof the who
Toll should be assigned over to him for the remainder [..]
the terme mentoned in the said Contract But in case
the Toll should produce more than one hundred
pounds p Ann the said John Mist< no role > did agree to be
accountable for the Surplus at the expiration of the said
terme, the charges of Four Shillings in the pound for
collecting the Duty and other incident charges first being
deducted And in regard it may be reasonably expected
that the Toll will fall short of one hundred pounds P
Ann The said Committee did at the request of the said
Mr. Mist promise and agree in such case to make
application to parliament, soe as that the Justices of peace
be at no expence for power to levy what shall be
deficient of one hundred pounds P Ann in the next
produce of the Toll on all the Inhabitants residing
within the Market who shall have benefit by the said
Toll And they further Certified that the said John
Mist desired that the present terme menconed in his
Contract might be made up twenty five years from
Lady day One Thousand seven hundred and thirty one
which not being in the power of the Committee by the
said Order to agree to they could only report it as
their opinion that they thought it reasonable to be
done and Submitt such his propsall to the consideracon
of the Court, This Court haveing considered of the
said Report doth agree thereto and doth hereby ratify
and confirm what the said Comittee have done in
the premisses And in consideracon that the said John
Mist hath already well and Substantially new pave
the said remaining part of the Hay Market which was
in a ruinous condicon at his own proper costs and
charges And that he his Executors or Administrators
Shall and Will in like manner well & Substantially
repaire amend and maintaine such pavement &
also the pavement of the other part of the Haye Market
