Order to prepare a
Claym of Right}

Upon reading the Report of Nathaniel Blackerby< no role > Esqr Sr. John
Gouson Knt. John Milner< no role > This name instance is in set 4214. John Crosse< no role > James Oglethorpe< no role > William
Wickham
< no role > John Martin< no role > Thomas Burdus< no role > Charles Moore< no role > and
William Cotesworth< no role > Esqrs . Justices of the peace of this County
appointed by order of Court as a Committee to inquire what
right the Justices of the peace of the Said County have of
attending the Sessions of Goal Delivery holden for the same
County at the Old Baily and the place & manner of their
sitting there, and whether covered or otherwise, and whether the
Justices of the peace of the other Countys of England who are not in
the Commission of Oyer & Terminer or Goal Delivery in the
other Countys of England Sit covered in Court, and to make
their Report touching the premisses, It appeareth to this Court
by the said Report that it hath been a constant Uninterrupted
Usage for the Justices of the peace of this County to be present at
the Sessions of Goal Delivery at the Old Baily if they thought
proper Soe to be or as occasion might require, And alsoe that
the East side of the Court had always been reserved for them,
and Strangers have been formerly turned out by the
direccon of the Court to make room for the Justices and for
their better accomodacon, which they conceive to be a Strong evidence
of their right to Sit on the East Side there, And that they can prove by
the most ancient of their Brothren(one of whom has been above
fifty yeares in the this Comission)That it hath been the constant
usage during that time for the Justices of the peace of this
County, and even for those of the City & Liberty of Westmr. to Sit
covered in the Court of Goal Delivery at the Old Baily when
they thought fit, And that their attendance at the Old Baily [..]
is required & very necessary for the publick Service in Order to
the Conviccon of Felous & other Criminals by produceing &
proving Confessions and Examinations as the Justices of the
peace in all the other Countys of England do at the Assizes, who
according to the best informacon that could be gained on this [..]
occasion sit covered on the Crown side when ever they please, they
attending by vertue of his Maties Commission and not as private
persons, whereupon this Court doth(Nemine contradicente)
Agree to the said Report, And doth Order that a Claym of right
of the Justices of the peace of this County to Sit on the East Side
of the Court of Goal Delivery at the Old Baily at the Execution
of the Commissions of Goal Delivery there, and to be Covered
there in Court with the grounds thereof be laid before the
