order to solicit their Lordships referrence thereupon to
His Majesty's procurateur General for his report as to the
Propriety of Complying with the Prayer of the said Memorial
which this Deponent has been informed and believes is
the practice in such Cases but was not able to precure
such referrence until on or about the Eleventh day of
this Instant April And this Deponent Further saith
That on the Thirteenth day of the said April the Solicitor
of the Admiralty received a Letter from the King's Proctor
saying That an Affidavit must he made in verification
of the said Memorial in consequence of which this
Deponent on the Following Day being the Fourteenth
waited upon the King's proctor and made such Affidavit
And this Deponent Further Saith That he hath been
informed and verily believes that on Monday the Sixteenth
Instant his Majesty's Proctor Made his Report to the
Lords of the Treasury That it might be proper to Comply
with the Prayer of the said Memorial And this Deponent
Further Saith That on the nineteenth day of this Instant
April he this Deponent was informed by Mr. Mitford one
of the Principal Clerks in the Treasury and which
Information This Deponent verily believes to be true
That the said Lords Commissioners of the Treasury had been
that day pleased to direct a Warrant to be made out
for his Majesty's Sign Manual thereby to appoint the
said Mr. Dyson Nominee on behalf of the Crown for the
purpose of litigating and calling in the said Probate And
that the said Warrant would be prepared and delivered
out in about Fourteen days from that time And this
Deponent Further saith that he hath been informed by
one of the Clerks in the Office of his Majesty's Proctor and
which he verily believes to be true that the probate
