ineffectual this Deponent on the Thirteenth day of the said
March waited upon Mr. Gostling the Admiralty
Proctor and
Consulted with him whether the probate of the said Will so
granted to the Prisoner could be litigated by any other Means
than by a Citation in the Name and at the Instance of the
next of Kin of the said deceased no such next of Kin being to be found
when the said Mr. Gostling Communicated to this Deponent
a joint Opinion of the King's Advocate and the advocate of
the admiralty
as to the mode of procuring, by a Memorial
to the Lords Commissioners of the Treasury
, his Majesty's
Nomination of a Person for the purpose of litigating the
Probate of a Pretended Will under similar Circumstances
with the Will in question Whereupon this Deponent
by the Direction of the Solicitor of the admiralty
forthwith
prepared a Memorial in his Name to their said Lordships praying for the
Reasons therein stated that they would be pleased to procure His
Majesty'
s Nomination of some Person or Persons authorizing
him or them to litigate the probate of the Will of the said deceased
granted to the Prisoner and to get the same duly worked or
pronounced by the ecclesiastical Court
to be null and void
and on or about the Fifteenth of the said Month of March this
Deponent caused a Copy of the said Memorial to be sent to
the said Mr. Goothing at Bath
with a Letter disiring him to
peruse settle and return the same as soon as possible
And this Deponent Further saith That on the twenty third
Day of the said March the said Mr. Gostling returned the
said Memorial with several necessary additions thereto and this
Deponent on or about the twenty Fifth day of the same
Month caused a fair Copy thereof to be presented to the
Lords Commissioners of His Majesty's Treasury
And
this Deponent further saith That he attended several times
at the Treasury
after presenting the said Memorial in
order
