return to his said Lodgings in a few days And the Deponent
Dent for himself saith that he is advised and verily believes

to be a material Evidence for
this Deponent upon the tryal of the Indictment in
thisproProsecution & that this Deponent cannot
Safely proceed to the tryal thereof without the Evidence

And the Deponent Turner
for himself Saith that he did on Saturday last serve
Messrs.WallWarry and Green wollers who act as the
Defendant's Sollicitors in this prosecution with a Notice
in writing purporting that the Session of Oyer and
Terminer holden for the City of London
at Justice Hall
in the Old Bailey
would he moved on Monday than next
at twelve of the Clock in the Morning that the tryal of the sd
Indictment
might be put off to the next Session on
account of the absence of a Material Witness on the
Part of the prosecution by deliveries the said Notice
