James Mitchell< no role > of Rotherhithe in the County of Surry Gentleman the
above named Defendant and Peter Mitchell< no role > of the same place Gentleman
severally make Oath and say and first this Deponent James Mitchell
for himself saith that the Tryal of this Deponent was at the last Session
of oyer & Terminer held at Justices Hall in the Old Bailey put off and
his Recognizance respited on an affidavit of the absence of John
Davies & Thomas London< no role > two of this Deponent makrise witnesses
before received and by Diligent Enquireys since made he hath been
able to find that the said John Davies< no role > resides at Bristol in the
County of Somersatt where he is an Innholder but this Deponent
did not know the same till the End of the last week which was not
Time enough to Subpena and being him before the Court to give
his Testimony for and on behalf of him this Deponent and that
nothwithstanding the Intelligance he had of the said Thomas London
being at Town Malling in Kent & residing there this Deponent hath
very early discovered that he does not devell there but in under
Misfortunes & secretes himself, but where or at whose House this Deponent
hath not as yet been able to learn although he hath used all posible
Diligence to find the said Thomas Lanson out and this Deponent
further saith that if he could have supenaed the before named John
Davies & Thomas Lanson he would have proceeded to Tryal this
present Session but this deponent saith he cannot safely precead thereto
without the Testimony of the said John Davies and Thomas Lanson
whom he will are his Utmost endeavour to Subpona and verily
believes he shall be all to produce them here the Denept of their
Testimony at the next Session and this Deponent Peter Mitchell for
himself saith that by the Order and Direction of the other Deponent
he went to the House of Mr. Willis at Lambeth where the said Thomas
London as was informed resides or in to be met with when in Town to
enquire for & Subpena him but was informed that the said Thomas
Lanson was gone to Lewisham and this Deponent enquired at the
said Mr. Coillis, and also at the New Inn where he was informed the
said Mr London some times search but could not get informed it where
House at what place the said Thomas Lanson was to be found
