Thomas Gardner< no role >
For Felony

Thomas Gardner< no role > of Mile End White Chapell Road
in the County of Middlesex Cheesemonger the above named
Prosecutor Maketh Oath and Saith, that he this Deponent
was bound by a Recognizance of Forty Pounds to prosecute
the above named Prisoner She having Robbed him of
Fourteen Pounds and a half of Bacon of the Value of Five
Shillings this Deponent in Consequence thereof Attended to
Prosecute the above named Prisoner, and preferred and found
a his Bill against her thereon at the Sessions House in the
County of Middlesex , and also Attended this Honble Court from
Wednesday the twenty Fifth day of February last untill Saturday
the twenty Eighth, to appear and give Evidence against her on
the said Indictments And this Deponent further Saith that
being informed that the Middlesex Jury was going of and the
London Jury coming on and being totally un acquainted with
such Proceedings, this Deponent and his Witness whent to a
Publick house called the Dolphin on Ludgate Hill to get some
refreshment, and during that time the Trial of the Prisoner was
brought on his Deponent not being absent above Fifteen Minites
And this Deponent further Saith, that the Recognizance became
Forfietedonthrough the occasion aforesaid, and that this Deponent
had not the least Intention but to prosecute the Prisoner thereon had
not the Prisoners Trial been called on in his absence, And this Deponent
Lastly Saith that he Attended from day, to Day with his Witness as
aforesaid, for the purpose of Prosecuting the said Indictment in
Discharge of the Conditions of the said Recognizances, but was prevented [..] so to
do merely through the Cause aforesaid, and no other they being actually
attending this Honble Court for that purpose as aforesaid except
the necessary time for their refreshment
