Thomas Dely of park lane in the County of Middlesex Brick lay etc
maketh Oath and saith that he this Deponent being bound by Recognizance
to prosecute John Oxford< no role > and Daniel Hurley< no role > for feloniously Ripping
Stealing and Carrying away Eighty four pounds Weight of lead fixed to a Dwelling
House of Pimlico the property of his Deponent [..] he this Deponent
one Monday last attended at the Session House on Clerkenwell Green
together with John Stillwell< no role > [..] who was under Recognizance to
give Evidence against the said John Oxford< no role > and [..] Hurley
and preferred a Bill of Indictment against the said John Oxford< no role > and
Daniel Hurley< no role > which was returned a time Bill And this Deponent
further saith that he was informed by several persons that the
That of the said John Oxford< no role > and Daniel Hurley< no role > would not
Come on the first day of the present Session And this Deponent
further saith that being in doubt about such Information
he this Deponent for greater Certainty attended this Honourable
Court about the hour of One in the Afternoon of this day and to this
Deponent great Surprize he then found that the Trial of the
said John Oxford< no role > and Daniel Hurley< no role > was within two or three
upon be List beyard the prisoner there upon Trial where upon this Deponent
Immediately hired a Coach and went there in to [..] in order
to bring the said John Still< no role > well with this Deponent to this
Honourable Court to give Evidence and prosecute the Law with
Effect against the said John Oxford< no role > and Daniel Hurbey
And this Deponent further saith that he arrived with the said
John Still< no role > well at this Court about half an hour after Two of the
Clock in the Afternoon of this [..] Eighth day of October when
this Deponent found that during this Deponent Abreme to Collect
his Withness the said John Oxford< no role > and Daniel Hurley< no role > had been
Acquitted and discharged for want of his Deponent Attendance
